Booking Conditions

These Booking Conditions apply to every seat, accepted pet allocation and service booked with Buddy Air. Please read them before accepting the booking declarations or making payment. They explain when a booking becomes binding, when a proposed flight is confirmed to operate, and the responsibilities of Buddy Air, the passenger, the pet owner and the licensed aircraft operator. Important booking notice A Booking Confirmation confirms a paid seat and accepted pet allocation. It is not a Flight Confirmation and does not mean that the proposed shared charter is confirmed to operate. Buddy Air will issue Flight Confirmation separately no later than 30 calendar days before scheduled departure, or notify you that the flight will not proceed. Important operating notice Every flight is operated by a duly licensed independent aircraft operator. The operator and captain retain exclusive operational control and final authority over safety, aircraft, crew, loading, baggage, seating, pet restraints, routing, departure, landing, diversion and carriage. Important cancellation notice Passenger cancellations are non-refundable unless the cancelled capacity is successfully resold as described in Section 7 or mandatory law requires another result. No refund is due for a no-show or customer-caused refusal of travel. 1 The parties and definitions 1.1 "Buddy Air", "we", "us" and "our" mean Blessedworks LLC, United Arab Emirates, trading as Buddy Air. The official website is FlyBuddyAir.com and the official general and legal contact is hello@flybuddyair.com. 1.2 "Customer" means the person who makes or pays for the booking. "Passenger" means each person accepted to travel. "Pet" means each animal identified and accepted in the Booking Confirmation. 1.3 "Operator" means the licensed air carrier or aircraft operator that operates the flight. "Booking Confirmation" means our written confirmation that cleared payment has been received and the stated seat and pet allocation have been accepted. "Flight Confirmation" means our later written notice that the shared charter has achieved its commercial and operational go-ahead and is expected to operate, subject to continuing safety, legal and operational requirements. 1.4 "Booking" means the Booking Confirmation, invoice, these Conditions, any written special condition or included service confirmed by Buddy Air, and any Operator conditions validly incorporated into the booking. 1.5 "UAE business day" means a day on which banks in the United Arab Emirates are generally open, excluding official public holidays. 1.6 "Outside Control Event" means an event beyond Buddy Air's reasonable control whose effects could not reasonably be avoided or overcome, including severe weather, natural disaster, epidemic, quarantine, animal-disease restriction, war, terrorism, civil disorder, sanctions, government or authority action, border or airspace closure, airport or runway closure, air-traffic restriction, strike, fuel interruption, critical-system or cyber failure, crew legality or illness, aircraft safety or maintenance decision, or failure of an essential supplier despite reasonable selection and mitigation. 2 Making and accepting a booking 2.1 A submitted booking form is a request for a seat and pet allocation on a specified shared charter. It is not a confirmed reservation. The Customer must provide complete, accurate and current information about every Passenger and Pet. 2.2 The Customer must receive or be given durable access to these Conditions before payment. Acceptance may be recorded by an online checkbox, electronic signature, written or email confirmation, or payment. Any full or partial payment made after these Conditions have been supplied or made available by a clear link constitutes the Customer's acceptance of, and agreement to be bound by, these Conditions whether or not a separate electronic acceptance was completed. 2.3 After a booking request is submitted, Buddy Air may issue an invoice and bank-transfer instructions automatically. An invoice does not by itself mean that the Passenger or Pet has been accepted, that capacity remains available, or that the proposed flight is confirmed to operate. 2.4 Unless the invoice states otherwise, the full invoiced amount must reach Buddy Air in cleared funds within three UAE business days. If it does not, the invoice may expire and the capacity may be released without further notice. 2.5 Buddy Air may review identity, travel, pet, health, behaviour, weight, breed, documentation, sanctions, payment, cabin-planning and operational information before or after payment. If we request additional information or ask the Customer in writing to pause payment, the deadline will be adjusted reasonably. 2.6 A Booking becomes binding only when Buddy Air has received the full invoiced amount in cleared funds and issued a written Booking Confirmation. An enquiry, discussion, booking request, invoice, attempted payment or partial payment does not confirm a Booking. 2.7 If money reaches Buddy Air for a request that Buddy Air does not accept, it will ordinarily be returned to the original payer within 7 to 10 working days after notice, subject to account verification and any lawful fraud, sanctions, anti-money-laundering or banking restriction. 2.8 The Customer must be at least 18 and legally capable of contracting. A Passenger under 18 is subject to Section 13. 3 Contract documents and Operator conditions 3.1 The Booking Confirmation, invoice, these Conditions and any written special condition or included service confirmed by Buddy Air form the agreement between the Customer and Buddy Air. A specific written term for the Booking prevails over a general website statement if inconsistent. 3.2 The Operator's contract or conditions of carriage, baggage rules, safety requirements and lawful instructions may also apply to the flight. Buddy Air may provide an additional Operator contract or conditions before or after Booking Confirmation, once the Operator is appointed, or at another stage before departure. 3.3 The Customer and every Passenger must review and comply with Operator conditions when provided. The Operator's lawful operational and safety rules control the operation of the aircraft. They do not remove any mandatory right or any obligation Buddy Air cannot lawfully exclude. 3.4 If a later Operator condition materially removes the agreed in-cabin pet allocation, changes the origin or destination city, or otherwise creates a Major Change under Section 8, the Passenger will have the remedies stated in that section. 3.5 The Operator and its personnel are intended to receive the benefit of provisions concerning operational authority, conduct, pet control, baggage, damage, reimbursement and indemnity, to the extent permitted by applicable law. 3.6 The Customer must check every Booking document promptly and report an incorrect name, Pet detail, route, date, fare or allocation. Failure to notice an error does not convert incorrect information into an agreed term. 4 Booking Confirmation and Flight Confirmation 4.1 Booking Confirmation secures the paid seat and accepted pet allocation under these Conditions. It does not guarantee that the proposed shared charter will operate. 4.2 A proposed shared charter depends on sufficient paid bookings across the relevant flight or linked rotation, a suitable aircraft, an available licensed Operator, necessary permissions and operational acceptance. 4.3 No later than 30 calendar days before scheduled departure, Buddy Air will either issue Flight Confirmation or notify booked Customers that the proposed flight will not proceed. Buddy Air may confirm earlier once the required commercial and operational arrangements are in place. 4.4 If Buddy Air cancels because the required booking level has not been achieved, the Customer may choose an available alternative Buddy Air flight or a full refund of the amount actually received by Buddy Air for the cancelled flight, excluding only any payment-processing, bank, intermediary-bank, currency-conversion or other transaction surcharge actually incurred and not recovered by Buddy Air. The Customer is not required to accept a credit or alternative. 4.5 After Flight Confirmation, Buddy Air will not cancel merely because booking numbers later fall below the commercial threshold. A confirmed flight may still be changed, delayed or cancelled for safety, legality, aircraft or Operator unavailability, authority refusal, an Outside Control Event or another reason permitted by these Conditions. 4.6 Flight Confirmation remains subject to the Operator's and captain's continuing authority, aircraft serviceability, crew duty limits, airport access, slots, routing permissions, weather, airspace, customs, immigration and animal-health requirements until the journey is completed. 5 Fare payment and additional amounts 5.1 The published seat fare is US$8,450 per Passenger for one one-way flight, unless a flight page and invoice expressly state a different fare. The invoice and Booking Confirmation state the fare, currency, seat, accepted Pet allocation and any expressly included service. If an AED payment option is offered, the invoice states the locked AED total for its payment window. No other service or item is included merely because it was discussed, advertised generally or physically appears possible. 5.2 The Customer is responsible for bank, intermediary-bank and currency-conversion charges. Payment is complete only when the full invoice amount is available to Buddy Air in cleared funds. 5.3 Buddy Air may change a fare before issuing an invoice. After full payment and Booking Confirmation, the agreed fare will not be increased because of an ordinary supplier-cost increase. However, if the actual cost of operating the flight materially increases because of an Outside Control Event or another circumstance beyond Buddy Air's reasonable control—including a substantial fuel-price increase, war, sanctions, airspace or airport closure, mandatory rerouting, an additional fuel stop, increased flying time or an Operator-imposed surcharge—Buddy Air may require an extraordinary flight surcharge. The surcharge will be limited to the actual additional costs charged by the Operator or another essential third-party supplier, together with directly related unavoidable transaction costs, and will be allocated reasonably among affected confirmed bookings. 5.4 Additional amounts may be payable for a Customer-requested change or service, inaccurate or incomplete information, damage, exceptional cleaning, delay or diversion caused by the Passenger or Pet, a fare difference, or a tax, government or authority charge that must lawfully be collected. 5.5 An extraordinary flight surcharge under Section 5.3 is a mandatory condition of continued participation in the affected flight. Buddy Air will give the Customer written notice of the reason, amount and payment deadline. If the Customer declines or fails to pay by that deadline, Buddy Air may cancel the Booking and retain sums already paid only to the extent necessary to cover actual, non-recoverable Operator, aircraft, routing, fuel, airport, handling, administration, payment-processing or charter costs already committed in respect of that Booking. Any remaining balance will ordinarily be returned to the original payer within 7 to 10 working days after the retained amount is determined and verified. A price increase caused by a Customer-requested change, inaccurate information or breach is separate and remains payable under Section 5.4. 5.6 A later promotion or lower fare does not change an existing Booking or create a right to price matching, credit or refund unless the promotion expressly states otherwise. 5.7 Buddy Air may delay, refuse, return, freeze or report a payment where reasonably required by sanctions, fraud prevention, anti-money-laundering obligations, banking rules or applicable law, and may request reasonable identity or source-of-funds evidence. 6 Passenger changes and transfer requests 6.1 A requested change is effective only when Buddy Air confirms it in writing. It may be subject to availability, Operator and authority approval, documentation, a fare difference and reasonable third-party costs disclosed before confirmation. 6.2 A minor spelling correction for the same Passenger will ordinarily be made without Buddy Air's own administration charge if reported promptly. The Customer remains responsible for any outside cost caused by a late manifest or document correction. 6.3 A Customer requesting transfer to another available Buddy Air departure 60 or more calendar days before the original departure may do so, subject to availability, eligibility, documentation, Operator approval and any fare difference or third-party cost. No cash refund arises from a transfer. 6.4 A date-transfer request made fewer than 60 calendar days before departure is treated as a cancellation unless Buddy Air successfully resells the released capacity or expressly agrees otherwise in writing. 6.5 A Passenger-name substitution requires at least seven calendar days' written notice. A shorter period may be considered only where Buddy Air and the Operator expressly accept it, and approval is not guaranteed. The replacement must satisfy all identity, immigration, document, health, behaviour, sanctions, Operator and cabin-planning requirements. 6.6 A Pet may not be added or replaced without written approval. A different Pet may affect weight, species, temperament, equipment, documentation, seating, separation and total Pet capacity. 6.7 The original Customer remains responsible until Buddy Air confirms the change in writing, receives all required information and declarations, and receives any additional amount in cleared funds. 6.8 If a confirmed Pet does not travel but the Passenger still travels, no part of the fare is automatically refundable. The fare is for the seat and accepted travel allocation, not a separate ticket price for each Pet. 7 Passenger cancellation resale and no show 7.1 Before payment, the Customer may withdraw the request or allow the invoice to expire without a cancellation charge. 7.2 After Booking Confirmation, a Passenger cancellation is non-refundable unless the cancelled seat and Pet allocation are successfully resold under this section or mandatory law requires another remedy. 7.3 Cancellation must be sent in writing to hello@flybuddyair.com, stating the booking reference, Passenger name, flight and clear instruction to cancel. It takes effect when actually received by Buddy Air. Do not rely on a social-media message or an unverified third-party contact for a cancellation. 7.4 The Customer may propose a substitute Passenger or Pet, but the Booking cannot simply be handed over. Buddy Air and the Operator must accept the substitute in writing under Section 6. 7.5 Buddy Air may try to resell cancelled capacity but does not guarantee resale and is not required to lower the fare, accept an unsuitable Passenger or Pet, compromise safety or cabin planning, or disadvantage the remaining charter. 7.6 A later booking counts as resale of the cancelled capacity only where it genuinely fills capacity that would otherwise have remained unsold because of the cancellation. Buddy Air will not be treated as having supplied a replacement merely because another booking is received later, unless the flight was otherwise sold out or the later booking specifically fills the released capacity. 7.7 After a genuine resale is fully paid and confirmed, Buddy Air will refund the amount paid for the cancelled capacity, less a US$25 processing fee, any non-recoverable banking or third-party cost directly caused by the cancellation or resale, and any shortfall where the capacity was resold for a lower net amount. The refund cannot exceed the original payment. 7.8 An approved refund will ordinarily be processed to the original payer and original remitting account within 7 to 10 working days after the refundable amount is determined and verification is complete. Bank and intermediary processing time is outside Buddy Air's control. 7.9 Passenger or Pet illness, injury, bereavement, work or relocation change, anxiety, visa difficulty, permit delay, incomplete documents or a change of plans does not alter this cancellation policy. Suitable travel and Pet insurance is strongly recommended. 7.10 A Passenger who fails to complete check-in by the stated cutoff, does not attend, or refuses or is unable to travel for a Customer- or Pet-caused reason is a no-show. No refund or credit is due, except where mandatory law requires otherwise. 7.11 A cancelled Booking does not automatically create future credit. Any concession, credit or rebooking arrangement must be confirmed by Buddy Air in writing and applies only to that Booking. 8 Changes delays cancellation and Major Changes 8.1 Flight dates and times are estimates until operated and are not guaranteed. Buddy Air or the Operator may reasonably change the time, private terminal, airport serving the same city, aircraft, registration, Operator, route, fuel stop, technical stop, seating or service detail for safety, legality, animal welfare or operational delivery. 8.2 A change is a Major Change if, before departure, it moves the flight to a different calendar day other than through an ordinary operational delay, changes the origin or destination city, causes a delay exceeding 48 hours, or removes the accepted in-cabin carriage of a Pet without a legally required reason. An extraordinary flight surcharge is governed exclusively by Sections 5.3 and 5.5 and is not by itself a Major Change. 8.3 A change of suitable Operator or aircraft, registration, private terminal or airport serving the same city, a reasonable schedule adjustment, a fuel or technical stop, a routing change, or a seat reassignment is not by itself a Major Change if the journey and accepted in-cabin Pet allocation can still be provided to a reasonably comparable standard. 8.4 If Buddy Air makes a pre-departure Major Change, the Customer may accept it or cancel the affected unused flight by the deadline stated in the notice and receive a full refund of the amount actually received by Buddy Air for that flight, excluding only any transaction surcharge actually incurred and not recovered by Buddy Air. If the Major Change occurs after an outbound or earlier sector is completed, the refund applies only to the affected service not provided. 8.5 The Operator and captain may delay, reroute, divert, return, make an additional stop or cancel when reasonably necessary for safety, security, weather, legality, aircraft serviceability, crew duty, animal welfare or operations. Their operational decision is final. 8.6 If Buddy Air cancels an affected flight and cannot provide a reasonable alternative accepted by the Customer, Buddy Air will refund the amount actually received by Buddy Air for the affected unused flight, excluding only any payment-processing, bank, intermediary-bank, currency-conversion or other transaction surcharge actually incurred and not recovered by Buddy Air. The refund will ordinarily be processed within 7 to 10 working days after verification. No credit or alternative will be imposed where the Customer is entitled to a refund. 8.7 If an Outside Control Event temporarily delays performance, Buddy Air may keep the Booking valid and work with the Operator on the next reasonably available departure, substitute aircraft, rerouting or other practical arrangement. An alternative is not guaranteed. 8.8 If an Outside Control Event makes the flight permanently impossible and the flight is cancelled, Section 8.6 applies, subject to any different mandatory rule. 8.9 Unless mandatory law requires otherwise, Buddy Air is not responsible for separately booked hotels, connections, ground transport, visas, Pet services, lost earnings, events or other arrangements not expressly included in the Booking. Customers should keep such arrangements flexible and insured. 8.10 Delay amenities, including accommodation, meals and ground transport, are not guaranteed unless required by law or expressly included. Buddy Air may provide assistance as a goodwill measure without creating an obligation in another case. 9 Passengers and travel documents 9.1 Each Passenger must hold every valid passport, visa, residency or transit permission, identity document, health document and other approval required for departure, transit and entry. 9.2 Passenger names must match the travel documents and aircraft manifest. Clear copies must be supplied by stated deadlines and required originals carried on the day of travel. 9.3 Buddy Air's acceptance or review of a document does not guarantee legal entitlement to travel or enter a country. Government authorities make those decisions. 9.4 If travel is prevented by missing, expired, incorrect, delayed, refused or insufficient Passenger documents or status, it is customer-caused and no refund is due except under Section 7 or mandatory law. 9.5 If an authority refuses entry, requires removal or imposes a fine or cost because of a Passenger's documents, status, conduct or unlawful item, the Customer must reimburse reasonable return travel, accommodation, handling, authority, professional and legal costs, to the extent permitted by law. 10 Pets accepted on Buddy Air 10.1 Buddy Air ordinarily accepts dogs and cats. Another small domestic Pet may travel only where Buddy Air, the Operator and all relevant authorities expressly approve it in writing. 10.2 One purchased Passenger seat permits either one accepted Pet of any permitted weight, or up to two accepted Pets whose combined actual weight does not exceed 25 kg. There is no separate 25 kg maximum for one Pet. Every allocation remains subject to lawful destination requirements, aircraft capacity, safe control, the cabin plan, Pet mix and the Operator's and captain's final safety decision. 10.3 A Pet does not automatically receive its own passenger seat. An additional seat for a Pet may be purchased only where Buddy Air offers and confirms it in writing. Human Passengers must occupy seats and use restraints as directed during taxi, take-off, landing, turbulence and whenever instructed. 10.4 Every Pet must be accompanied by a responsible Passenger. Buddy Air does not transport unaccompanied Pets or provide a Pet nanny. If the owner does not travel, an authorised person may accompany the Pet with any required written consent. 10.5 For two Pets with one Passenger, that Passenger must be able to control and care for both throughout check-in, boarding, flight and disembarkation. Buddy Air may require another capable adult, an additional seat or another arrangement if safe management is doubtful. 10.6 Only Pets identified in the Booking Confirmation may travel. The Customer must accurately disclose species, breed, age, sex, weight, health, medication, travel history, pregnancy and any known anxiety, reactivity, aggression or behaviour relevant to safety. 10.7 A change in weight, health, medication, pregnancy, behaviour or other material circumstance must be reported promptly. It may require reassessment, veterinary evidence, different seating or equipment, an additional cost or refusal if safe and lawful travel cannot be arranged. 10.8 Buddy Air may limit the number, size, species or mix of Pets and does not guarantee a particular row, sofa, floor space or separate seat. Seating may be reassigned before or during travel for safety and welfare. 11 Pet health documents and regulatory compliance 11.1 The owner is responsible for every export, import, transit, identification, vaccination, microchip, testing, health-certificate, permit, treatment, quarantine, breed, species and animal-welfare requirement applying to the Pet and route. 11.2 The owner must disclose if the Pet will be sold, rehomed or transferred, if the owner will not travel within a legally required period, if the movement may be commercial, or if any restriction may apply because of species, breed, age, pregnancy, health, CITES status or dangerous-animal law. 11.3 Buddy Air may provide general information, reminders, checklists or introductions to veterinarians and relocation providers. Those resources are assistance only and do not transfer the owner's legal responsibility or guarantee the accuracy of independent advice. 11.4 The owner must upload or send legible copies by every deadline and carry all required originals. Buddy Air may share them with the Operator, broker, airport, handler, veterinarian, relocation provider or authority to arrange and check the Booking. 11.5 A document marked received, reviewed or internally accepted by Buddy Air is not a government approval, official veterinary certification or guarantee of boarding, entry or release. Authorities and the Operator retain their own decisions. 11.6 Optional Documentation Support is an administrative and coordination service only. It does not transfer, replace or reduce the owner's sole and continuing responsibility for understanding, obtaining, maintaining and independently verifying every document, test, treatment, appointment, permit, certificate, deadline and legal requirement applying to the Pet and route. Even where Buddy Air or its documentation partner prepares or submits an application, coordinates an appointment, or applies for or obtains a stated import or export certificate, no assurance is given that an authority, Operator or other third party will issue, accept or continue to recognise it. 11.7 Buddy Air or its documentation partner will perform only the tasks expressly confirmed in the written service description or invoice. The owner must provide complete, accurate and timely information; attend appointments; make the Pet available; supply samples and originals; check documents when received; disclose changes; and meet every deadline. Government application fees are included only where expressly stated. Veterinary consultations, vaccinations, microchipping, tests, blood collection, serum preparation, cold-chain shipping, laboratory charges, local transport, crates and other excluded third-party costs remain the owner's responsibility unless expressly included in writing. 11.8 To the fullest extent permitted by law, Buddy Air is not responsible for an error, delay, refusal, expiry, change of requirement or other outcome caused by the owner, Passenger, veterinarian, laboratory, courier, relocation provider, authority, Operator or another independent party. A Pet unable to travel because of a missing, late, incorrect, invalid, expired or refused document, test, vaccination, treatment, permit, health condition or legal requirement is a customer-caused refusal and no refund is due, except where mandatory law requires otherwise or the loss was directly caused by Buddy Air's legally established failure to perform a specific written task. 11.9 The owner bears reasonable quarantine, veterinary, kennel, handling, storage, re-documentation, return, repatriation and other third-party costs arising from the Pet's documents, health or eligibility. To the fullest extent permitted by law, the Customer will indemnify Buddy Air and its personnel against reasonable fines, penalties, losses, costs and third-party claims caused by inaccurate, incomplete, unauthorised or late information or documents, failure to cooperate or comply, or another breach by the Customer, Passenger or Pet owner. This indemnity does not apply to the extent mandatory law places responsibility on Buddy Air for its own act or omission. 12 Pet safety behaviour and equipment 12.1 Pets must remain under the direct control and supervision of their responsible Passenger. Every lawful and reasonable instruction from Buddy Air representatives, the Operator, crew, airport, handler or authority must be followed immediately. 12.2 Every dog must wear a secure, correctly fitted collar or harness and remain on a short leash during airport movements and on board, except where the crew directs otherwise. Any tethering or restraint method must be approved by the Operator and must not obstruct an aisle or exit. 12.3 Every dog must arrive with a suitable, correctly sized muzzle that permits safe breathing and panting. It must be shown at check-in and used whenever reasonably required by Buddy Air, the Operator, crew or an authority. Buddy Air may carry limited backup stock, but availability and correct fit are not guaranteed and do not transfer the Passenger's responsibility. 12.4 Cats must remain in a secure, ventilated, escape-resistant soft-sided carrier throughout the journey unless the captain or crew expressly directs otherwise. The carrier must fit the confirmed cabin plan and must not block an aisle or exit. 12.5 A dog blanket or protective covering may be required. Dog beds and other bulky cabin items are not permitted unless Buddy Air approves them in writing because they may restrict cabin space. 12.6 An anxious or reactive Pet is not automatically refused. Buddy Air may request further information, a behavioural or veterinary assessment at the Customer's cost, a pre-boarding observation period, specific equipment, a seating change or separation from another animal. 12.7 Do not allow a Pet to approach another Passenger or animal without permission. The responsible Passenger must prevent uncontrolled roaming, persistent disturbance, fighting, biting, scratching, escape, fouling or damage. 12.8 Do not sedate or tranquillise a Pet unless specifically advised by a veterinarian, accepted by the Operator and permitted by law. All calming or other medication given before or during travel must be disclosed. 12.9 Full meals may not be fed on board. Small quantities of treats or a chew and small amounts of water may be permitted as directed by the crew. Owners should obtain veterinary advice on feeding and hydration; Buddy Air may recommend that the last full meal be given at least six hours before departure. 12.10 Bring absorbent pads, waste bags, cleaning items, essential medication and reasonable Pet supplies. The crew controls how and where they may be used. Litter trays are not supplied and, if permitted, must be used only in the location directed and left clean. 13 Children passenger health and assistance 13.1 Passengers must ordinarily be at least seven years old. A child aged 7 to 15 must travel with a responsible adult. A Passenger aged 16 or 17 may travel without an accompanying adult only with written parental or guardian consent, Operator approval and the ability to control and muzzle any accompanying dog if required. 13.2 The Customer must disclose sufficiently in advance any reduced mobility, pregnancy, serious medical condition, severe allergy, infectious disease, oxygen requirement, medical equipment, assistance animal or other circumstance affecting safe carriage or aircraft suitability. 13.3 Buddy Air will pass relevant assistance requests to the Operator and airport and use reasonable efforts to facilitate them. Assistance remains subject to notice, aircraft limitations, safety, security and law. The Operator retains the final decision. 13.4 The Passenger is responsible for medical advice, medication, fit-to-fly evidence and an accompanying carer where reasonably required. Nothing in these Conditions permits unlawful discrimination or removes a mandatory accessibility right. 14 Baggage and cabin items 14.1 Each purchased Passenger seat includes a maximum of 30 kg (66 lb) of checked baggage, divided across no more than two normal-sized bags, plus one small personal item in the cabin comparable to a handbag, purse, small laptop bag or compact backpack. 14.2 There is no passenger overhead-bin or under-seat storage for ordinary cabin baggage. Roller bags, cabin suitcases, large backpacks and other oversized cabin items are not permitted in the cabin. 14.3 Additional, excess or overweight baggage cannot be purchased or requested as an entitlement. Baggage over the confirmed allowance, oversized baggage and undeclared items may be refused or offloaded, even if the Passenger offers to pay. Refusal of excess baggage does not create a refund right. 14.4 Pet carriers, blankets, food, supplies, mobility items and safety equipment count within the 30 kg allowance unless Buddy Air confirms otherwise in writing. Essential medical or accessibility equipment must be disclosed in advance and is subject to lawful accommodation and Operator approval. 14.5 All baggage and items remain subject to aircraft weight, balance, storage, screening, security, customs and Operator limits. The Customer must provide accurate bag counts, dimensions and weights when requested. 14.6 Keep passports, permits, original Pet documents, essential medicines, valuables, money, keys and irreplaceable items with you where the Operator permits. Buddy Air is not the baggage carrier. Baggage liability is governed by mandatory law, applicable conventions and the Operator's conditions. 15 Check in reporting and no show 15.1 The final flight brief will state the terminal, reporting time, check-in process and final boarding cutoff. Passengers should ordinarily expect to arrive 60 to 90 minutes before scheduled departure, but the flight brief controls. 15.2 The reporting period may include identity, baggage, security, document and veterinary checks and a supervised observation or socialisation period for Pets. Arrival at the airport is not the same as completed check-in. 15.3 Every Passenger and Pet, all original documents, permitted baggage and required safety equipment must be present and checks completed by the stated cutoff. The Operator is not required to delay departure. 15.4 A Passenger not present at the boarding area or otherwise ready to board by the cutoff stated in the flight brief may be declared a no-show and the seat may be released to a standby Passenger. Section 7 applies. 15.5 If delay or a document or Pet issue is anticipated, contact Buddy Air immediately. Notice does not require the Operator to hold the flight but may allow available options to be assessed. 16 Passenger conduct prohibited items and inspection 16.1 Passengers must comply immediately with lawful and reasonable safety, security, seating, screening and operational instructions. 16.2 A Passenger must not threaten, abuse or harass; interfere with crew; tamper with the aircraft or equipment; block an aisle or exit; smoke or vape; use or carry illegal drugs; smuggle any person, animal or item; become intoxicated; or create a safety, security or welfare risk. 16.3 All bags, carriers and items may be screened or inspected. Refusal permits the item or Passenger to be denied carriage. Suspected unlawful conduct may be reported to the authorities. 16.4 Explosive, flammable, toxic, infectious, corrosive, unlawful, dangerous or inadequately packed items are prohibited. Firearms, ammunition, weapons and restricted goods are prohibited unless Buddy Air and the Operator expressly approve them in writing in advance and every legal and security requirement is met. 16.5 Alcohol may be carried or served only with Operator approval and consumed only as directed. The crew may refuse or stop service and may refuse carriage to a person who appears impaired. 16.6 Wi-Fi, entertainment, catering, seat features and other amenities depend on the aircraft and may be unavailable. Their absence does not create a refund unless expressly sold as a material separate service. 17 Refusal removal emergencies and entry refusal 17.1 Buddy Air, the Operator, captain or an authority may refuse or discontinue carriage of a Passenger, Pet, bag or item where reasonably necessary for safety, security, welfare, hygiene, legality or operation. 17.2 Customer-caused refusal includes lateness, non-payment, false or incomplete information, missing documents or equipment, failure to follow instructions, undisclosed or materially changed circumstances, inability to control a Pet, or unacceptable Passenger or Pet conduct. No refund is due except under Section 7 or mandatory law. 17.3 If a Pet was accurately and fully disclosed and accepted, but carriage is later refused solely because Buddy Air or the Operator changes an acceptance decision for a reason not caused by the Customer or Pet, Buddy Air will assess a reasonable alternative or refund under Section 8, subject to the cause and applicable law. 17.4 In an apparent emergency, Buddy Air may arrange reasonable medical, veterinary, welfare or temporary-care assistance if the Customer cannot be reached. The Customer authorises those arrangements and must reimburse reasonable third-party costs except to the extent caused by Buddy Air's legally established breach. 17.5 If an authority orders inspection, testing, isolation, quarantine, seizure, treatment, return or another lawful action, Buddy Air may comply and arrange reasonable assistance. Where lawful and practicable, Buddy Air will try to contact the Customer before any irreversible action. 17.6 A diversion or alternative arrival procedure may require a Pet to be processed temporarily through cargo, animal-import or holding facilities separately from the owner. This is distinct from carriage of the Pet in the aircraft hold. Buddy Air will use reasonable efforts to obtain information, support welfare and prompt reunification but cannot control authority access or release timing. 17.7 A Passenger or Pet removed or refused entry is responsible for onward travel, accommodation, Pet care, handling, quarantine and return arrangements unless the event was caused by Buddy Air's breach or mandatory law requires another result. 18 Damage cleaning and reimbursement 18.1 The Customer is responsible for reasonable steps to prevent injury, escape, fouling, delay, disturbance or damage caused by every Passenger and Pet under the Booking. 18.2 The Customer is responsible for and must pay all reasonable repair, replacement, specialist-cleaning, diversion, additional-landing, delay, authority and professional costs caused by a Passenger or Pet, excluding ordinary wear and routine cleaning. Buddy Air may invoice those amounts following a determination by the Operator or relevant supplier and will provide available photographic, invoice or other supporting evidence where reasonably possible. The absence of a photograph does not extinguish responsibility where the damage or cost is established by other reliable evidence. 18.3 Buddy Air will provide a reasonable description and available supporting information. The Customer must raise a genuine dispute promptly. Charges must reflect actual loss, account for condition and available recovery, and must not duplicate compensation. 18.4 To the fullest extent permitted by law, the Customer will defend, reimburse, indemnify and hold harmless Buddy Air, the Operator, their affiliates, officers, directors, employees, contractors, representatives and agents from and against any third-party claim, demand, action or proceeding, and all resulting fines, penalties, liabilities, losses, damages, costs and reasonable legal or professional expenses, arising from inaccurate, incomplete or unauthorised information; breach of these Conditions or applicable law; negligent or wilful conduct by the Customer or a Passenger; or injury, escape, fouling, delay or damage caused by a Passenger or Pet. This indemnity does not apply to the extent a claim results from the negligence, fraud or deliberate misconduct of the person seeking protection. 19 Buddy Air and the Operator 19.1 Buddy Air markets, arranges and coordinates shared private charter travel with Pets and any related assistance expressly stated in the Booking. Buddy Air does not own or operate the aircraft, employ the flight crew for the operation or exercise operational control. 19.2 The licensed Operator has possession and operational control of the aircraft and is responsible for airworthiness, crew and safe operation. The captain has final authority over whether, when and how a flight operates and whether any Passenger, Pet, baggage or cargo may board or remain on board. 19.3 Buddy Air may replace a proposed Operator or aircraft with another duly licensed Operator or suitable aircraft. No refund arises solely from substitution if the journey, accepted in-cabin Pet allocation and reasonably comparable standard remain available without a Major Change. 19.4 Buddy Air will use reasonable care when selecting an Operator or broker and in checking available evidence of relevant operating approval and insurance. Buddy Air does not independently certify aircraft airworthiness or guarantee that an approval will remain in force. 19.5 A veterinarian, relocation company, broker, airport, handler, ground-transport provider, hotel and other outside provider is independent unless the Booking Confirmation expressly states that Buddy Air itself provides the service. Assistance or introduction does not make that provider Buddy Air's employee or agent. 20 Responsibility liability release indemnity and insurance 20.1 Buddy Air is the arranger and coordinator of the Booking. It is not the direct air carrier, aircraft operator, employer of the flight crew, veterinarian, border authority or guarantor of any independent service. The licensed Operator and other travel or professional suppliers are independent contractors and are not Buddy Air's employees or agents. 20.2 To the maximum extent permitted by law, Buddy Air excludes any and all liability for loss, expense, delay, property damage, personal sickness, injury or death affecting a Passenger or Pet, or any other loss of whatsoever nature arising in connection with the Booking or flight, except to the extent applicable mandatory law does not permit that liability to be excluded or limited. 20.3 Without limiting Section 20.2, Buddy Air is not responsible or liable for any act, omission, negligence, decision, delay, refusal, defect or failure of an Operator, air carrier, captain, crew member, aircraft, airport, authority, veterinarian, laboratory, courier, relocation provider, handler, broker or other independent supplier; any Outside Control Event or other cause beyond Buddy Air's direct and immediate control; or any loss caused or contributed to by a Customer's or Passenger's breach, inaccurate or incomplete information, failure to cooperate or mitigate, or a Pet's condition, behaviour or natural characteristics. 20.4 To the fullest extent permitted by law, Buddy Air is not liable for indirect, incidental, consequential, special, exemplary or punitive loss; loss of income, profit, use, opportunity, enjoyment, reputation or anticipated savings; emotional distress; or the cost of independently booked connections, accommodation, transport, services or events. 20.5 Where Buddy Air is legally responsible for direct financial loss arising from a Booking, its aggregate liability will not exceed the total amount actually received by Buddy Air for the affected Booking, unless mandatory law prohibits that limit. This cap does not reduce a refund expressly due under these Conditions. 20.6 To the fullest extent permitted by law, Buddy Air is not responsible or liable for a Pet's illness, injury, escape or death arising from a pre-existing or undisclosed condition, breed or anatomical characteristic, age, pregnancy, natural behaviour, travel stress, medication, owner or Passenger act or omission, authority decision, aircraft operation or independent provider. 20.7 International air carriage may be governed by the Montreal Convention, Warsaw Convention, UAE aviation law, other mandatory aviation law and the Operator's conditions. Nothing in these Conditions enlarges or reduces liability governed mandatorily by those rules. 20.8 To the fullest extent permitted by law, the Customer, for themselves and every Passenger and Pet owner included in the Booking, releases, discharges and waives all claims against Buddy Air, its affiliates, directors, officers, employees, contractors, representatives and agents arising from or relating to any matter described in Sections 20.2, 20.3 or 20.6, including loss, delay, expense, property damage, sickness, injury or death affecting a Passenger or Pet. This release does not apply to any liability that applicable mandatory law does not permit to be excluded, limited, released or waived. 20.9 Customers should obtain appropriate travel, cancellation, medical, baggage, personal-liability and Pet insurance covering delays, route changes, refusal, quarantine, veterinary treatment, emergency care, injury, death and repatriation. Insurance is a separate contract, and denial of a claim does not transfer the insurer's risk to Buddy Air. 21 Communications data and Buddy Air Concierge 21.1 Official booking, cancellation and complaint notices to Buddy Air must be sent to hello@flybuddyair.com or through an authenticated website function expressly provided for that purpose. A notice to Buddy Air is effective when actually received through an official channel. 21.2 Buddy Air may send booking and operational messages to the email address and secure account associated with the Booking. Buddy Air may use another private contact channel only when the Customer has requested or agreed to it for that Booking. Customers must keep contact details current, check spam or filtered messages and monitor nominated channels from 72 hours before departure until completion. 21.3 Buddy Air Concierge and automated website responses provide general information and assistance only. They do not provide legal, immigration, veterinary or medical advice; certify documents; guarantee acceptance; confirm a flight; alter a Booking; waive these Conditions; or override an Operator or authority. A material commitment or Booking change binds Buddy Air only when confirmed in writing through an authorised Buddy Air channel. 21.4 Buddy Air may collect, use, store and share Passenger and Pet information as reasonably necessary to process payment, assess and perform the Booking, plan the cabin, conduct safety and document checks, comply with law and handle complaints or claims. Further details will appear in Buddy Air's Privacy Policy. 21.5 Information may be shared with the Operator, broker, airport, handler, authority, veterinarian, relocation provider, bank, payment provider, insurer, professional adviser and other supplier, including recipients outside the Customer's country. A Customer providing another person's information confirms authority to do so. 22 Complaints claims and chargebacks 22.1 A problem arising before or during travel must be reported promptly so there is a reasonable opportunity to investigate and correct it, especially where it concerns safety, a Pet, baggage or an ongoing service. 22.2 A written complaint should state the booking reference, Passenger, flight, date, issue, requested outcome and supporting documents, photographs or receipts. It should preferably be submitted within 14 calendar days after the affected flight or cancellation, without shortening a mandatory legal claim period. 22.3 Before initiating a payment dispute or chargeback, the Customer should give Buddy Air a reasonable opportunity to investigate unless urgent action is reasonably required. A chargeback does not decide contractual liability. 22.4 If a chargeback or payment reversal is finally determined to lack a valid basis, the Customer remains responsible for the unpaid contractual amount and reasonable recovery costs to the extent permitted by law. 23 General legal terms 23.1 These Conditions and the other Booking documents identified in Section 3 form the entire agreement for the Booking. They replace earlier discussions and statements but do not exclude fraud or a representation that applicable law makes binding. 23.2 A variation or waiver is effective only when confirmed in writing by an authorised Buddy Air representative. Failure or delay in enforcement is not a waiver. 23.3 Buddy Air may update these Conditions for future bookings and may amend the Conditions applying to an existing Booking where reasonably required by law, an authority, an Operator's lawful rule, safety, security, operational necessity, an Outside Control Event or correction of a material error. Buddy Air will provide or make available the updated Conditions where reasonably practicable. Continued participation in the Booking, travel, or any further payment after the updated Conditions are provided constitutes acceptance to the extent permitted by law. A change that creates a Major Change remains subject to Section 8, and no amendment removes a mandatory right. 23.4 The Customer may not assign or transfer the Booking except through the approved process in Section 6. Buddy Air may subcontract performance and may assign rights or obligations as part of a genuine business transfer or reorganisation where this does not materially reduce mandatory Customer protection. 23.5 If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions continue. Headings do not affect interpretation. 'Including' means including without limitation. 23.6 Each Passenger remains responsible for their own eligibility, documents and conduct and for each Pet travelling under their allocation. Where more than one Customer is named, each is responsible for obligations relating to their own Booking unless mandatory law provides otherwise. 23.7 These Conditions are provided in English. If another language version is required by law, Buddy Air will provide the required information or version. Any conflict is resolved as required by mandatory law. 23.8 The Booking and these Conditions are governed by the federal laws of the United Arab Emirates and, where applicable, the laws in force in the Emirate of Dubai. 23.9 Subject to any mandatory consumer forum, exclusive statutory jurisdiction or other jurisdiction that cannot lawfully be varied, the courts of Dubai, United Arab Emirates, have exclusive jurisdiction over any dispute arising from or connected with the Booking or these Conditions. 23.10 Before commencing proceedings, the parties should attempt in good faith to resolve the dispute through written escalation for 15 UAE business days, unless urgent relief or a mandatory limitation period requires earlier action. 23.11 Nothing in these Conditions excludes, restricts or waives a consumer, passenger, aviation, data-protection or other right or remedy that applicable law does not permit the parties to exclude, restrict or waive. 24 Acceptance declarations By accepting electronically or in writing, or by making any full or partial payment after these Conditions have been supplied or made available by a clear link, the Customer confirms that: • the Customer received or had durable access to these Booking Conditions before payment; • the Customer has authority to act for every named Passenger and Pet owner; • all information and documents supplied are authentic, accurate, complete and current; • the Customer understands that Booking Confirmation is not Flight Confirmation; • the Customer understands and accepts the passenger-cancellation, resale, no-show, refund and extraordinary-surcharge rules; • every Passenger accepts the Operator's and captain's final operational and safety authority; • every Pet owner accepts responsibility for documentation, control, equipment, welfare and compliance; • the Customer and every Passenger acknowledge the allocation of responsibility for documents and optional Documentation Support under Section 11; • the Customer has read and accepts the exclusions, indemnities, release and waiver of claims in Sections 18 and 20 to the fullest extent permitted by law; and • the Customer agrees to pay the invoiced fare and every additional amount properly due under these Conditions.
